Synopsis



Beginning in September I begin receiving spams that claim that I have already been approved for a 3.5% mortgage, or that I can save $514 compared to my current monthly payment, yadda yadda yadda. The investigation that followed revealed that nothing could be further from the truth. None of the mortgage companies that called me had record of any application, nor was I pre-approved for ANY rate, let alone 3.5%. None of them had any idea how much money I could save.

Notice that the original spam below has all of these light grey words (highlight them to make them more readable) in the body of the email. These are intentionally added to make the email appear to be unique, thereby fooling the spam filters. Also, the words appr o v a l and Mo r tg age has spaces in it. This is another countermeasure to prevent spam filters for catching them. They have not held anything back. They want to

By sending (or causing to send) email that misrepresents the point of origin of the email the sender is in violation of Oklahoma Statutes Title 15 Section 776.1(A)(1). By sending an email which contains false or misleading information, (e.g. “We recently received the application ”) the sender is in violation of Oklahoma Statutes Title 15 Section 776.1(A)(3) which states:
§ 776.1

A. It shall be unlawful for a person to initiate an electronic mail message that the sender knows, or has reason to know:

1. Misrepresents any information in identifying the point of origin or the transmission path of the electronic mail message;

2. Does not contain information identifying the point of origin or the transmission path of the electronic mail message; or
3. Contains false, malicious, or misleading information which purposely or negligently injures a person.
By sending (or causing to send) email that falsifies the transmission information within the email, the sender is in violation of Oklahoma Statutes Title 15 Section 776.6(A)(1)
§ 776.6

A. It shall be unlawful for a person to initiate an electronic mail message that the sender knows, or has reason to know:

1. Falsifies electronic mail transmission information or other routing information for the unsolicited commercial electronic message;
or
2. Contains false or misleading information in the subject line.

Liability of the Sender(s)

WebGuy Internet Solutions meets the definition of an email service provider as defined by Oklahoma Statutes Title 15 Section 776.4(5) which states:
§ 776.4
5. "Electronic mail service provider" means any person who:

   a. is an intermediary in sending or receiving electronic mail, and
   b. provides to end-users of electronic mail services the ability to send or receive electronic mail.
WebGuy Internet Solutions wishes to pursue a lawsuit for statutory damages in the amount of $300,000.00 as provided for by Oklahoma Statutes Title 15 Section 776.2(C) which states:
§ 776.2
   C. If the injury arises from the transmission of unsolicited or commercial electronic mail messages, an injured electronic mail service provider may also recover attorneys' fees and costs and may elect, in lieu of actual damages, to recover the greater of Ten Dollars ($10.00) for each and every unsolicited commercial electronic mail message transmitted in violation of this act, or Twenty-five Thousand Dollars ($25,000.00) per day.
